Rouzer Statement on Texas v. Pennsylvania Amicus Brief

Congressman David Rouzer (NC-07) today issued the following statement after he joined more than 125 of his House Republican colleagues in filing an amicus brief in support of the plaintiffs in Texas v. Pennsylvania, now pending before the U.S. Supreme Court: 

“My colleagues and I filed this brief to ask the US Supreme Court to answer a critically important constitutional question,” said Congressman Rouzer.  “Article II, Sec. 1, cl. 2 of the U.S. Constitution clearly states that Presidential Electors must be appointed according to rules established by each state’s legislature.  However, in the months before the 2020 election, those rules were deliberately changed in these states by governors, secretaries of state, election officials, judges and/or private parties — not their respective state legislatures. 

“The brief requests that the Supreme Court uphold the clear authority of the state legislatures to establish the manner by which electors are appointed, and determine the constitutional validity of any ballots cast under rules and procedures established by actors or public bodies other than state legislatures.  This is a critically important question for future elections as well.  

“Whether you believe the Presidential election was fair and square or suspect, it is my belief this specific question needs to be adjudicated by the Supreme Court in order to remove any ambiguity and help restore confidence in our electoral system,” Rouzer said.
